WEBIVIO PLATFORM TERMS OF SERVICE
§1. General provisions

These Terms of Service define the rules for using the Webivio Platform, the conditions for the provision of services by electronic means by the Service Provider, the rights and obligations of Creators, and the principles governing the parties' liability.

The Webivio Platform is a SaaS (Software as a Service) offering, intended primarily for entrepreneurs and online creators.

Use of the Webivio Platform requires prior review of these Terms of Service and acceptance of their content.

These Terms of Service form an integral part of the Agreement concluded between the Service Provider and the Creator.

The Webivio Platform is not a party to agreements concluded between Creators and Webinar Participants.

The Webivio Platform is solely a technological tool enabling the organization of webinars, auto-webinars, sign-up pages, and communication automation.
§2. Definitions
The terms used in these Terms of Service have the following meanings:
Auto-webinar
A webinar or video material played automatically and made available to Participants using the functionality of the Webivio Platform.
CTA
Buttons, links, offers, or other interactive elements displayed to Webinar Participants.
Pricing
The current list of prices for services available on the Webivio Platform.
Webinar Data
All data related to the activity of Webinar Participants, including analytical data, webinar activity, CTA clicks, chat messages, traffic sources, UTM data, webinar viewing time, attendance status, and technical device data.
DPA
The data processing agreement concluded between the Creator and the Service Provider.
AI Features
Functionalities that use artificial intelligence models, including content generation, webinar analysis, participant activity analysis, communication generation, or marketing automation.
External Integrations
Third-party services and systems integrated with the Webivio Platform, in particular MailerLite, ActiveCampaign, GetResponse, SMSAPI, WhatsApp Business Platform (Meta), Klaviyo, Kit, Meta Pixel, Google Analytics, and others.
Creator Account
An individual user account enabling the use of the Webivio Platform.
Billing Period
The period for which the subscription fee for using the Webivio Platform is charged.
Webivio Platform
A SaaS platform enabling the organization of webinars, auto-webinars, sign-up pages, webinar analytics, and communication automation.
Replay
A webinar recording made available to Participants after the broadcast has ended.
GDPR
Regulation (EU) 2016/679 of the European Parliament and of the Council.
Website
The website available at https://webivio.com and its subdomains.
Sign-up Page
A website created using the Webivio Platform that serves to register Participants for a Webinar.
Creator
A natural person, legal person, or organizational unit using the Webivio Platform.
Webinar Participant
A person registering for a Webinar organized by a Creator.
Service Provider
Cashly Finance sp. z o.o.
Webinar
An online event organized using the Webivio Platform.
WhatsApp Business Platform
Meta's official platform enabling businesses to send and receive WhatsApp messages via the WhatsApp Cloud API (Business API), including the management of message templates and the WhatsApp Business Account (WABA).
WhatsApp Notifications
Automated messages sent to Webinar Participants through the WhatsApp Business Platform channel, in particular sign-up confirmations, reminders before the webinar, and follow-up messages after the webinar.
§3. Scope of the Webivio Platform's services
- The Webivio Platform enables, in particular:
- organizing webinars and auto-webinars,
- creating sign-up pages,
- managing participant sign-ups,
- sending system messages,
- sending webinar reminders,
- sending WhatsApp notifications (when the Creator enables and configures the integration),
- handling Participants' WhatsApp replies (notifications to the Creator),
- handling webinar replays,
- integrations with external systems,
- analyzing webinar participant activity,
- analyzing webinar effectiveness,
- managing CTAs and offers,
- managing access to webinars,
- streaming and hosting webinar materials,
- handling the webinar chat.

The Webivio Platform operates on a subscription model.

The Service Provider may offer trial periods and trials.

The Service Provider may develop the Platform with new functionalities, including AI features.

The Service Provider may use subcontractors and sub-processors necessary for providing the services.
§4. Technical requirements
- Use of the Platform requires:
- a device with internet access,
- an up-to-date web browser,
- an active email address,
- JavaScript and cookies enabled.

The Service Provider recommends using the latest versions of the Chrome, Safari, Firefox, or Edge browsers.

The Service Provider is not liable for technical issues resulting from a failure to meet the technical requirements on the part of the Creator or the Webinar Participant.
§5. Creator Account

Creating a Creator Account is free of charge.

One Creator Account may be used by only one person.
-
Sharing a Creator Account among multiple persons is prohibited.

The Creator is responsible for the security of their login credentials.
-
The Creator is obliged to provide truthful and up-to-date information.
-
The Service Provider may suspend or delete a Creator Account in the event of:
- a breach of these Terms of Service,
- unlawful activities,
- activities threatening the security of the Platform,
- spam,
- phishing,
- attempts to circumvent system limits,
- account sharing,
- infrastructure abuse.
§6. Subscriptions and payments

The Platform operates on a monthly or annual subscription model.

The subscription renews automatically until it is disabled by the Creator.

The Creator may disable the automatic renewal of the subscription independently.
-
Fees are charged in advance for the given Billing Period.
-
The Platform may offer a 14-day trial period.
-
After the trial period ends, access to paid functionalities may be restricted.
-
The Service Provider uses Stripe as its payment operator.
-
Fees are non-refundable once the Billing Period has commenced, except in situations required by law.
-
The Service Provider may change the prices of its services. Price changes do not affect billing periods that have already been paid for.
§7. Personal data and the roles of the parties

The Creator is the controller of the personal data of Webinar Participants.
-
The Webivio Platform acts as a processor of personal data in accordance with Article 28 of the GDPR.
-
The Creator is responsible for:
- the lawfulness of data collection,
- fulfilling information obligations,
- having an appropriate legal basis for processing,
- the compliance of marketing activities with applicable regulations.

The Webivio Platform processes data solely on the documented instructions of the Creator.
-
Detailed rules for data processing are set out in the DPA.
§8. External integrations

The Platform enables integration with third-party services.
-
Integrations operate via APIs and external systems.
-
The Service Provider is not liable for:
- changes on the part of external services,
- the unavailability of integrations,
- errors in the operation of third parties,
- API limitations of external providers.

The Creator is responsible for the correctness of the integration configuration.
-
Meta Pixel and Google Analytics may be configured by the Creator.
-
The Creator is responsible for the compliance of their use of External Integrations with applicable law, in particular with regard to the protection of personal data and marketing communications.
§8a. WhatsApp integration (Meta WhatsApp Business Platform)

The Webivio Platform enables Creators to send WhatsApp Notifications to Webinar Participants via the WhatsApp Business Platform (Meta Cloud API).

The WhatsApp integration requires connecting the Creator's WhatsApp Business account to the Platform — by default via Embedded Signup (Facebook Login for Business within the Webivio panel). Manual configuration of Meta credentials remains available solely for support or migration purposes.

The Creator represents and undertakes that:
- they have the right to use the connected phone number and WhatsApp Business account,
- they have obtained the required opt-in from Participants to be contacted via WhatsApp in accordance with the law and the WhatsApp Business Policy,
- they have fulfilled their information obligations toward Participants (including in the Creator's privacy policy),
- the content of the messages sent complies with the law, these Platform Terms of Service, and Meta's policies,
- they accept the WhatsApp Business Terms and the Meta for Developers terms.

Messages sent outside the 24-hour window from the Participant's last message require message templates approved by Meta. The Creator is responsible for the correctness of the template content and its compliance with the category (Utility / Marketing) indicated in Meta.

The costs of using the WhatsApp Business Platform (Meta's fees for conversations / messages) — to the extent applicable — are borne by the Creator directly with Meta, unless the Service Provider explicitly indicates a different model in the Pricing or a separate agreement. The Webivio Platform subscription does not include Meta's WhatsApp fees.

The Creator is responsible for adding and maintaining a valid payment method in Meta Business Manager (where required by Meta) and for settlements with Meta.

The Service Provider provides only a technical service consisting of:
- storing and securing the Creator's Meta credentials,
- sending messages on behalf of the Creator in accordance with the webinar configuration,
- assisting in creating / submitting message templates to Meta (API),
- forwarding notifications of incoming messages from Participants (e.g., email to the Creator).
- The Service Provider is not liable for:
- the rejection, suspension, or deletion of message templates by Meta,
- the blocking or restriction of the Creator's WhatsApp Business account by Meta,
- non-delivery of messages resulting from errors on the part of Meta, telecommunications operators, or the Participant's device,
- Meta's decisions regarding the verification of the Display Name, phone number, or business account,
- the lack of opt-in or a breach of the law by the Creator.

When a Participant replies to a WhatsApp message, Meta opens a 24-hour window for free-form communication in accordance with Meta's rules. The Creator may reply to the Participant, among other places, in Meta Business Suite → Inbox → WhatsApp. The Service Provider does not guarantee a complete conversation history in Meta's tools for messages sent solely via the API.

It is prohibited to use the WhatsApp integration for:
- spam and unsolicited bulk communication,
- sending content that violates the WhatsApp Business Policy,
- circumventing Meta's limits,
- sending messages without the required Participant opt-in,
- storing or processing payment card data in the content of WhatsApp messages.
- The Service Provider may temporarily disable WhatsApp sending for a given Creator in the event of a breach of these Terms of Service, Meta's policies, or a threat to the reputation of the Platform.
§9. Webinars, streaming, and hosting of materials

The Platform enables the hosting and streaming of webinar materials.

The Creator is responsible for the lawfulness of materials published using the Platform.

The Creator represents that they hold all rights required to publish the materials, including copyrights and the rights to use the image, trademarks, and other protected elements.

It is prohibited to publish materials that are:
- unlawful,
- infringing copyrights,
- infringing personal rights,
- containing malware,
- containing phishing or scam content,
- inciting hatred or violence,
- violating the law or good practice.

The Service Provider may remove materials that violate the law or these Terms of Service without prior warning.

The Service Provider may temporarily or permanently restrict access to a Webinar or materials that violate these Terms of Service.
-
The Platform may use external streaming, hosting, and CDN services.
-
The Service Provider is not liable for limitations arising from the operation of external providers' infrastructure.
§10. AI and automation

The Platform may use AI features.
-
AI features may include:
- content generation,
- message generation,
- webinar analysis,
- participant activity analysis,
- communication automation,
- marketing recommendations,
- webinar effectiveness analysis,
- generating summaries and transcriptions,
- webinar chatbots.

Results generated by AI are of an auxiliary nature.
-
The Creator is responsible for the final publication of content generated by AI.
-
The Service Provider does not guarantee the correctness, effectiveness, or legal compliance of content generated by AI.
-
The Service Provider may use third-party services that provide AI models.
-
AI features may be developed and modified as the Platform evolves.
§11. Platform security

The Service Provider applies security measures appropriate to the nature of the services.
-
The Platform uses, among others:
- TLS encryption,
- security monitoring,
- security logs,
- rate limiting,
- backups,
- anti-spam monitoring,
- infrastructure monitoring,
- application error monitoring,
- abuse protection mechanisms,
- cloud infrastructure safeguards.

Data is stored primarily within the European Union.
-
The Platform uses, among others:
- Supabase,
- Railway,
- Vercel,
- AWS,
- Cloudflare,
- Stripe,
- Sentry,
- Google Analytics,
- Meta,
- OpenAI,
- MailerLite.
- The Service Provider may monitor user activity to the extent necessary to ensure the security of the Platform and to counteract abuse.
§12. Service availability and SLA

The Platform is provided on a "best effort" basis.

The Service Provider may:
- carry out maintenance,
- temporarily restrict functionalities,
- apply throttling and rate limiting,
- implement security mechanisms,
- temporarily disable services in emergency situations,
- restrict access to selected features in the event of a threat to the security of the Platform.

The Service Provider does not guarantee uninterrupted availability of the Platform.

Planned technical work will be communicated with appropriate advance notice, where possible.
-
The Service Provider may temporarily suspend the operation of some functionalities in order to protect infrastructure or data security.
-
The Service Provider may implement technical limits related to the security, stability, or performance of the Platform.
§13. Limitation of liability
- The Service Provider is not liable for:
- the actions of Creators,
- the actions of Webinar Participants,
- the effectiveness of webinars,
- sales results,
- the operation of external integrations,
- lost profits,
- indirect damages,
- force majeure events,
- data loss resulting from the actions of third parties,
- business decisions made by Creators,
- the actions of AI and their consequences.

The Service Provider's total liability toward the Creator is limited to the amount of the fee for the last Billing Period.

The Service Provider's liability is limited to actual damages.
-
The Service Provider is not liable for temporary interruptions in service availability resulting from maintenance, failures of external providers, or security measures.
-
The Creator is liable to the Service Provider for damages resulting from a breach of these Terms of Service or applicable law.
§14. Prohibited activities
- It is prohibited to use the Platform for:
- spam,
- phishing,
- scams,
- MLM,
- pirated courses,
- malware,
- copyright infringement,
- circumventing limits,
- scraping,
- unlawful webinars,
- activities threatening the security of the Platform,
- attempts to gain unauthorized access,
- distributing unsolicited communications,
- activities that violate the law.

The Service Provider may immediately suspend an account upon suspicion of abuse.

The Service Provider may remove Webinars or content that violate these Terms of Service.

The Service Provider may block traffic or activities deemed to threaten the security of the Platform.
§15. Data and retention
-
The Creator may export data available on the Platform to the extent made available by the Service Provider.
-
After the subscription ends, access to data may be restricted or removed.
-
Data is stored only for the period necessary to provide the services and to ensure the security of the infrastructure.

Data may be temporarily stored in backups and security logs in accordance with the retention policy.
-
After an account is deleted, data is removed from operating systems and backups in accordance with the retention cycle.
§16. Complaints and technical support

Complaints should be submitted to support@webivio.com.

Complaints are handled within 14 days.
-
Technical support is provided by electronic means.
-
The Service Provider may conduct technical and organizational communication with the Creator by email.
§17. Intellectual property
-
All rights to the Webivio Platform belong to the Service Provider.
-
The Creator is granted a non-exclusive license to use the Platform.
-
It is prohibited to copy, decompile, reverse engineer, or circumvent the security measures of the Platform.
-
Use of the Platform does not entail the transfer of any intellectual property rights.
-
All trademarks, logos, materials, and technological solutions related to the Platform are subject to legal protection.
§18. Amendments to the Terms of Service

The Service Provider may update these Terms of Service.
-
Users will be informed of changes with appropriate advance notice.
-
Continued use of the Platform after the changes take effect constitutes acceptance of the new Terms of Service.
-
If the changes are not accepted, the Creator may cease using the Platform.
§19. Final provisions
-
These Terms of Service are governed by Polish law.
-
In matters not regulated herein, the provisions of Polish law and the provisions of the GDPR shall apply.
-
Disputes between the Service Provider and the Creator will be resolved by the competent common courts.
-
These Terms of Service are effective as of the date of their publication on the Website (last updated: 03.06.2026).
